Best Business Practices for handling evidence while in court, specifically regarding procedures to follow in the event of an evacuation.

Lee County Clerks here - If there is evidence already secured by Clerk in court - it would leave the room with Clerk or be locked in the lockers behind the Judge's area. Our Clerk's don't evacuate with the room or through regular office procedure. If an evacuation occurs, they go with the Judge and Bailiffs for safety and notify their superiors as applicable.


If evidence has not yet been submitted to Clerk - the party with the evidence (state/defense/other) is responsible for the item(s) until in Clerk possession. I don't have a written policy to provide right now but I will ask the Supervisors in Court Services if they happen to have something written down for evacuations specifically.
