FES Unusual decision
We've recently run an individual through FES for a stored firearm case - The individual came back approved BUT when we look at the individual's court cases/the report they are the defendant for at least 2 active felony cases. Though the first appearance doesn't say anything about firearm possession.
We've asked FDLE about it and they re-iterated that this individual has no prohibitors - Has this ever happened for anyone else? What did you do in that instance?

My understanding from our legal department is Gov. Ron DeSantis signed a bill requiring law enforcement return firearms to their owners if the weapons were seized during an arrest. back in 2024. Per F.S.S. 790.08 (1)(b)
The legislation requires law enforcement return any weapons, electric weapons or devices, or arms taken from a person during an arrest, so long as the weapon is not needed for evidence or seized and subject to forfeiture.
